Terms and Conditions of Sales

 

General Conditions


 

1.        Unless otherwise specified, all prices do not include any applicable sales taxes, freight and/or insurance charges.

2.        Prices are subject to change without prior notice and will be established at time of order.  Please call or email for a copy of order confirmation.

3.        Product availabilities and / or Prices for backordered Products are not guaranteed.

4.        Allway Technologies is not responsible for any errors or omissions. 

5.        Deposits are required for special order items from overseas.  Please obtain a formal quotation with specific terms and conditions at time of order.

6.        Order cancellation charges applied for special ordered items. 

 

 

Shipping


 

1.        All shipments are F.O.B. our warehouse.

2.        Freight and insurance are the responsibility of the customer(s).

3.        All shipments may be insured at customer's expense unless written pre-advice is forwarded to us.

4.        Customers must report any shipping shortages and damages to the Courier Company and Allway Technologies Inc immediately.

5.        All shipments will be sent by courier ground at customer's expense unless otherwise specified by the customer(s).

6.        All backorders will be shipped courier ground collect unless otherwise specified by the customer(s).

 

Payment


 

1.        All sales are to be prepaid before delivery or by cash or Debit Card at time of pick-up. 

2.        Net Terms on Accounts with approved credit only.

3.        Bank Transfers, Preprinted company cheques will be accepted upon credit approval.

4.        Bank counter cheques and/or personal cheques are not accepted.

5.        Conditions applied to payments by Electronic Fund Transfer, email Payment, Credit Card (VISA & Master Card).  Please ask for details.

6.        Outstanding invoices are subjected to late payment charge of 2% per month plus any additional charges such as collection costs and attorney fees.

7.        $35.00 charge per each returned cheque.

8.        The title of all merchandise remains Allway Technologies Inc. until payment is received in full

 

Sales Returns


1.        Please call or email to obtain RMA number before returning goods.  Items invoiced after 30 days will not be accepted for returns. 

2.        Return for Credit only, no cash refunds. All credits will apply to future purchases. 

3.        Returned products will only be accepted in its original packing and in complete set, including all materials, manuals, accessories, software CD, etc. and in resellable condition.

4.        20% restocking charge applies to all goods returned after 15 days. 

 

Returns of Evaluation items


 

1.        Conditional sales and evaluation items are processed as regular sales and invoiced. 

2.        Conditional sales and evaluation items may apply to credit approved accounts only.

3.        Standard evaluation period - 15 days.

4.        Full credit less shipping cost will be issued to all evaluation items within evaluation period.

5.        For products not returned within the evaluation period, the invoice will be forwarded to accounting for payment process.

6.        For products returned after evaluation period, a restocking fee, 15% of invoice value will be applied - Please obtain a RMA number before goods are shipped back to us.

 

Claims


1.        All claims for shortage, damage due to shipping must be made within 2 days after receipt of goods.

2.        DOA claims must be made within 5 days after receipt of goods. 

3.        Original invoice must be presented if warranty services are required

4.        Charges may be imposed for unreasonable repair services if required

5.        All warranty returns will be subject to the RMA Policy and Procedures. Retain your invoice for future warranty service

 

Product Warranty


1.        Unless specified otherwise, all products are sold with a one-year parts and labour warranty against defects in material and workmanship.

2.        Warranty will be void if product is found to be damaged by accident, misuse, misapplication or as a result of service rendered other than by authorized personnel of Allway Technologies Inc.

3.        Warranty will be voided if any identification mark or serial number has been removed or tampered with.

4.        This warranty does not cover defects caused by misuse or physical damages via shipping or by the customer.

5.        There is no implied warranty that products will fit any particular purpose.

6.        Allway Technologies will not, whether expressed or implied, be liable for any damages resulting from the use of our products.

 

 RMA Policy


 

RMA stands for “Return Merchandise Authorization” and covers products under Warranty only.  .

 

1.        Unless otherwise specified, our products are covered by the manufacturer's standard 1-year parts/labour warranty.

2.        The warranty does not extend to cover any merchandise that is damaged physically, or as a result of any misuse, mishandling or improper installation on the reseller's/User's part.

3.        Manufacturer / vendor reserves the right to:

·          Repair or replace the defective merchandise

·          Replace the defective merchandise with similar product

·          Refund – at original or current price, the lower price will apply.

4.        A RMA Number MUST be obtained prior to returning any merchandise.

5.        To obtain a RMA number, A RMA Form must be filled out, email or fax to us.

6.        Please state problems clearly.  Do not simply write “DEAD” or “Defective”. 

7.        Dealers / re-sellers are responsible for verifying the problems before requesting for RMA.

8.        Our support department is available to assist our dealers in determining whether the product is defective, to provide a fix or direct enquiries to manufacturer for recommendation, before RMA number is required or RMA item(s) to be returned.

9.        NFF (No Fault Found) Charge - A $30.00 diagnostic fee applies if no problems are found and the RMA item is in good working condition,

10.     For computer systems RMA, a minimum $130 will be charged if problems are related to virus found or any other software problems.

11.     RMA form can be downloaded at www.allway.ca.

12.     RMA number MUST be written clearly on the outside.  Do not write or stick any labels on original box(es) if this is a return-for-credit RMA.

13.     Some items are required to be shipped back in FULL set. 

14.     Proof of Purchase MUST be included with the shipment - a copy of the original invoice or quoting the invoice number.

15.     RMA number is valid for 10 days. Please drop off the RMA item(s) at our office or ship the RMA item(s) to us pre-paid.

16.     Allway Technologies Inc is not responsible for any damages or loss of software programs, or data. Please back up data before send in RMA item(s).
